In order to comply with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and applicable Guidelines (the “Law”), DNSS, S.A. de C.V., its affiliates and/or subsidiaries, and/or related parties (“DANIELA SALCEDO®”), with address at Socrates #390, Polanco II Sección, Delegación Miguel Hidalgo, Mexico City, 11530 (the “Address”), with electronic address www.danielasalcedo.com (the “Site”) and other present and future digital platforms and web and/or mobile applications owned by it, with contact email customerservice@danielasalcedo.com (the “Email”); hereby makes available to you the following:
PRIVACY NOTICE
For the purpose of providing legitimate, controlled, and informed processing of your personal data that you currently provide or may provide in the future and that is contained in our databases, or that has been collected through cookies or any other web tracking technology, as well as to guarantee your privacy and your right to informational self-determination when providing such data, DANIELA SALCEDO® is responsible for the use and protection of your personal data, which will be processed based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and accountability set forth in the Law.
USE OF INFORMATION
The information you provide to us through access, registration, and creation of a User account on the Site, and/or by email, and/or by completing physical or electronic forms or surveys, in real time or historically, will be processed and organized to generate data indicators that DANIELA SALCEDO® may use to make business-related decisions. All collected information will be used for statistical purposes, in a general and non-personalized manner, and will be associated with the growth, maintenance, and administration of DANIELA SALCEDO®, always respecting your privacy. These uses include our internal operations and administration, communication with you, and the fulfillment of service and/or product requests provided by DANIELA SALCEDO®, as well as to improve, develop, refine, and provide DANIELA SALCEDO® services through its related parties, affiliates, authorized providers, and/or business partners, establishing appropriate measures to limit the use of the information collected from you solely for legal and authorized purposes in accordance with this Notice, as well as with proper confidentiality and security measures.
DANIELA SALCEDO® may also collect your IP (Internet Protocol) address to help diagnose problems with the DANIELA SALCEDO® server and to administer the Site. An IP address is a number assigned to your computer when you use the Internet. Your IP address is also used to help identify you within a particular session and to collect general demographic information. DANIELA SALCEDO® may use “push” technology through the application used by DANIELA SALCEDO® to send notifications with the User’s prior authorization. This means of communication does not have any access to other functions or information on the device used to connect to the Site. The information may include the URL you come from (whether or not it is on the Site), which URL you access next (whether or not it is on the Site), the browser you are using, as well as the pages visited, searches performed, posts, commercial preferences, messages, etc.
USE OF COOKIES
DANIELA SALCEDO® informs you that, through the use of cookies and similar technologies, it seeks to guarantee the best possible experience on the Site by providing personalized information, remembering your service and marketing preferences, and helping you obtain the appropriate information. USE OF THIRD-PARTY PLATFORMS AS A MEANS OF DATA COLLECTION
The Personal Data that DANIELA SALCEDO® may request, as mentioned in section 1 of this document, may be collected through manual entry by the User of the requested information on the Platform or through authorization to use data contained in platforms such as alegra®, Shopify®, Google®, or any other that DANIELA SALCEDO® considers useful for the purposes of its Platform (“Data Collection Platforms”), subject to the User’s prior registration of an email account on such platform. The request for User data is made through the Platform’s link to the API (Application Programming Interfaces) integrated into the alegra® platform: Privacy Notice; Shopify® View privacy policy, or on the Google Inc. platform: https://developers.google.com/terms/api-services-user-data-policy.
The Personal Data that DANIELA SALCEDO® may collect through the Data Collection Platforms will be subject to the terms and conditions contained in the Privacy Notice of such Platforms.
1. PERSONAL DATA REQUESTED
DANIELA SALCEDO®, and/or its parent companies and/or affiliated and/or subsidiary companies and/or related parties (the “Related Third Parties”), and/or those third parties who, due to their commercial relationship with DANIELA SALCEDO®, have contracted the use of the Site to complement their business proposal and have the need to process and/or use your personal data (the “Client”), and/or due to the nature of their work or functions have the need to process and/or use your personal data, such as suppliers or business partners of DANIELA SALCEDO® (“Business Partners”), request and obtain personal data in general, as well as personal data considered sensitive by the Law (hereinafter “General Personal Data” and “Sensitive Personal Data,” respectively; and jointly referred to as “Personal Data”) from the persons described below.
Sensitive Personal Data may be requested by electronic or physical means, with the understanding that all information provided physically will be considered and treated as if it had been provided and authorized on the Site, and therefore will be governed by this document.
In all cases, the collection of Personal Data by DANIELA SALCEDO® is carried out in good faith and for the purposes stated herein; therefore, it is presumed that the data provided by its holders is true and complete, and the holder providing such data is responsible for it.
A) CLIENTS, AS USERS OF THE SITE
The Personal Data that may be collected from Clients who use the Site is necessary to document the commercial and legal relationship that exists or may exist with each of them, and to carry out the purpose of the contracted services. The Personal Data that you will voluntarily and freely provide by yourself or through your Administrators consists of information that is included or may be included in contracts, letters, forms, lists, databases, or other physical and/or electronic means, as applicable, so that DANIELA SALCEDO® may document the relationship between the parties, maintain an adequate record of the business relationship with its business partners; as well as fully comply with internal policies, procedures, and other legal obligations applicable to DANIELA SALCEDO®.
The Personal Data that will be requested from you are the following:
General
● full name;
● corporate landline and/or mobile phone number;
● personal and corporate email address;
● address.
Employment Relationship
● name of the company where you work;
● job title/position;
● name of the work department;
● corporate email address;
● phone number of the person who acts as your direct supervisor in your job position.
Organization
● legal name and corporate name;
● trade name of the Organization;
● sector or industry to which it belongs; and
● Federal Taxpayer Registry Code (RFC) of the Organization.
B) BUSINESS PARTNERS (OR SUPPLIERS).
The Personal Data that will be collected from Business Partners consists of information that is included or may be included in contracts, letters, forms, lists, databases, or other physical and/or electronic means, as applicable, in order to maintain an adequate record of the business relationship with the Business Partners and to document the service contracting process or commercial relationship between the Parties; as well as to fully comply with internal policies, procedures, and other legal obligations applicable to DANIELA SALCEDO®.
The Personal Data collected from Business Partners are:
● name of the individual or corporate name;
● registered address;
● Federal Taxpayer Registry Code (“RFC”);
● landline and/or mobile phone number;
● name and position of the person acting as the main contact;
● corporate landline and/or mobile phone number of the person acting as the main contact; and
● corporate email address of the person acting as the main contact;
● banking details for deposit or electronic transfer for services provided to the Client; and
● those specific to process purchase orders.
All Personal Data is processed by DANIELA SALCEDO® and placed in a repository for processing, in order to fulfill the purpose of the Services acquired by the Client.
2. PURPOSES OF PROCESSING PERSONAL DATA
The Personal Data provided to DANIELA SALCEDO® through the Site will be used as previously mentioned, for the purpose of:
a. processing data to create a registry of Clients and the products they manage through the Site;
b. handling requests for purchase, exchange, loss, warranty application, and repair made through the Site, as well as the applicable follow-up processes;
c. properly operating and providing the services implicit in the Client’s acquisition of products on the Site;
d. providing necessary advice and follow-up to Clients and third parties related to DANIELA SALCEDO®’s e-commerce service;
e. enabling the Client to manage their account on the Site;
f. fulfilling services provided by Business Partners related to the Client’s acquisition of DANIELA SALCEDO® products;
g. conducting promotional and marketing activities for new products and/or services available on the Site; and
h. processing banking data to carry out payment for purchases through the payment gateways made available to Clients.
Once the purposes for processing your Personal Data have been fulfilled, and when there is no legal provision establishing otherwise, DANIELA SALCEDO®, at its sole discretion and with the authorization of the Data Subject, may use the collected data exclusively for statistical purposes in a general and non-personalized manner, associated with the growth, maintenance, and administration of DANIELA SALCEDO®, always respecting the privacy of the Data Subject.
The processing carried out by the payment gateways made available by DANIELA SALCEDO® with respect to the collected Personal Data shall be subject to the terms and conditions of the Privacy Notice contained on the website of the third party providing the payment gateway services.
3. TRANSFER
TRANSFER OF PERSONAL DATA AND INFORMATION. The Personal Data referred to in this Notice may be transferred to: (i) related third parties and/or business partners, in order to enhance DANIELA SALCEDO®’s value proposition and to offer you other products and services based on your needs; (ii) Mexican and foreign judicial authorities, for the purpose of complying with the Law, legislation, notifications, requirements, or judicial orders; (iii) internet service providers on whose infrastructure DANIELA SALCEDO®’s technological platform is hosted; and/or (iv) technical support service providers for the Site. In the event that any transfer of your Personal Data requires your express consent, you will be informed in order to obtain such consent.
In all cases, DANIELA SALCEDO® will communicate this Privacy Notice to such third parties and will ensure, through the execution of agreements and/or the adoption of other binding documents, that such third parties maintain the necessary administrative, technical, and physical security measures to safeguard your Personal Data, and that they use your Personal Data solely for the purposes for which it was collected. Likewise, DANIELA SALCEDO® and any other person related to DANIELA SALCEDO® who has access to the information contained in this Privacy Notice shall be bound to safeguard it under the same standards of security and confidentiality, and not to disclose or misuse it; otherwise, they shall be liable in accordance with applicable laws.
If the data has been obtained through links to the Data Collection Platforms made available by DANIELA SALCEDO®, such data shall be processed in accordance with the guidelines set forth in the Privacy Notice of such Data Collection Platforms.
Notwithstanding the foregoing, DANIELA SALCEDO® will not transfer your Personal Data to third parties unrelated to DANIELA SALCEDO®, except in the cases mentioned above and those provided by the Law, without your prior consent.
4. MEANS AND PROCEDURES TO EXERCISE ARCO RIGHTS
As the holder of the Personal Data provided to DANIELA SALCEDO®, you may at any time request the exercise of your rights of access, rectification, cancellation, or opposition (the “ARCO Rights”) regarding the processing of your Personal Data, consisting of:
(i) accessing your Personal Data and the details of its processing;
(ii) rectifying your Personal Data if it is inaccurate or incomplete;
(iii) canceling your Personal Data when you consider that it is not required for any of the purposes set forth in this Privacy Notice, is being used for non-consented purposes, or your contractual, service, or other relationship with DANIELA SALCEDO® has ended; and
(iv) opposing the processing of your Personal Data for specific purposes.
For this purpose, you must submit your request in writing to DANIELA SALCEDO®, or send your request to the Email, as applicable, which must contain at least the following information:
(a) your full name and address, or another suitable means to communicate the response to your request;
(b) documents proving your identity or, where applicable, that of your legal representative;
(c) a clear and precise description of the Personal Data with respect to which you seek to exercise any of the aforementioned rights; and
(d) any other element or information that facilitates the location of the Personal Data, as well as any other document required by the regulations in force at the time the request is submitted.

5. REVOCATION OF CONSENT; LIMITATION ON THE USE AND DISCLOSURE OF PERSONAL DATA
You may also revoke, at any time, the consent you have granted to DANIELA SALCEDO® for the processing of your Personal Data, as well as request that its use and disclosure be limited, provided that no legal provision prevents it. For this purpose, you must submit your request in writing to DANIELA SALCEDO®, or send your request to the Email, as applicable. Such request must comply with the same requirements mentioned in Section 4 above.
The response to your request will be provided by DANIELA SALCEDO® within the terms and timeframes established by the Law. However, you may obtain more information about the status of your request and the response period by contacting DANIELA SALCEDO® or by sending your request to the Email, where any clarification or doubt you may have regarding the processing of your Personal Data and the exercise of your ARCO Rights will also be addressed.
If your Personal Data had been previously transferred prior to the date of revocation of consent and continues to be processed by data processors of DANIELA SALCEDO®, the latter will inform such processors of the revocation so that they may proceed accordingly.
6. CHANGES TO THE PRIVACY NOTICE
DANIELA SALCEDO® reserves the right to modify and/or update this Privacy Notice, in whole or in part, at its sole discretion, in which case it will communicate such changes through the Site and, depending on the particular case of each data subject, through its internal networks, or by means of a notice placed in its usual communication channels (physical or electronic) and in a visible place at the Address, or through a written notice sent to your email address, as legally required.
7. DIGITAL, ELECTRONIC, OR ONLINE FORM
The Parties agree that the means to formalize their agreement may be through Digital, Electronic, or Online format, whereby it shall be sufficient to express consent through acceptance, as well as by providing personal data directly on the DANIELA SALCEDO® Site, without the need to execute or sign any physical document.
